
11 Feb JC White Law Client Awarded Summary Judgment on Liability in Copyright Case
Our client Leachman-Stoller LLC received a substantial win in the Eastern District of North Carolina. They are a home plan designer and brought suit alleging that a developer had marketed their plans as its own.
The Court found:
- The Developer engaged in copyright infringement by using our client’s designs without authorization, by altering their plans to include defendants’ name and by marketing those plans without permission. The court found seventy-nine separate violations.
- The Developer violated their copyrights by engaging in a minimum of eight unauthorized builds of homes based on plans they did not have a license to use. The court noted that there were another fifty-three builds that a jury could find also infringed our client’s copyright.
- The Developer’s owner is personally vicariously liable for any infringement by his company.
This is a huge win for our client, and the case will now go to a jury to determine damages.
